The following Terms of Service establish a contract between Softmatic GmbH, Berlin, Germany ("Softmatic") and you. The terms include the provisions set forth in this document and in the respective privacy policy. Should you not agree to these terms, you do not have the right to access or use the service(s) and / or product(s) as listed below. If you do register for, subscribe or otherwise use our service(s) and / or product(s) you accept these terms and the respective privacy policy.

The product can be downloaded and used free of charge from the App Store.
Certain features of the product are made available on a paid subscription basis ("Pro features"). To access these features you will be billed in advanced on a recurring and periodic basis. Available billing cycles are monthly or yearly. For the subscription period you will be charged the fees and taxes applicable to that cycle as detailed below.
At the end of each billing cycle, your subscription will automatically renew ("Auto-Renewal") and your payment method for the subscription will automatically be charged within 24 hours prior to the end of the current cycle. For the new subscription period you will be charged the fees and taxes applicable to that cycle as detailed below and under the same conditions as the prior billing cycle unless you cancel it.
Subscriptions are made available through In-App purchases (IAP) from within the product and can be managed through your account settings in the App Store app.
All billing is handled by the App Store and is governed by the App Store's own terms and conditions.
You may cancel your subscription auto-renewal in the App Store at any time. You will not receive a refund for the fees you already paid for your current subscription period and you will be able to access the "Pro features" of the product until the end the current subscription period.
The "Pro features" of the product are also available through a one time payment. With the "Lifetime license" you will be billed only once. After purchasing the license, you are entitled to use the product on your devices without restriction or time limit.
Softmatic may, at their own discretion, offer to access the aforementioned "Pro features" of the product for a limited time a no cost ("Free Trial"). A free trial can anytime be cancelled until the last day of the trial period by following the cancellation procedures outlined above. If you do not cancel your free trial, the free trial will be converted to a paid subscription at the end of the trial period. You will then be charged the applicable fees for the type of subscription you have selected. You may then cancel your subscription as outlined above. Any unused portion of a trial period is forfeited if you purchase a subscription before the trial period expires.
The fees for the subscription and the lifetime license as outlined above are displayed in the app and on the respective product page in the App Store.
Softmatic reserves the right to modify at any time the fees for the available billing cycles. Any change in fees will become effective at the end of the current billing cycle. Softmatic will announce upcoming changes to the fee structure four weeks prior to the change.
Refunds for subscriptions purchased through In-App purchases are governed by the App Store refund policy as outlined here.
The product may provide data from third-party services, henceforth "External Services". Softmatic is not responsible for assessing the accuracy or evaluating the content of External Services, and shall not be liable for any such External Services. Data displayed by any External Service, including but not limited to meteorological and location information, is for general informational purposes only. External Services may not be available in all languages and may not be available for use in any particular location. Softmatic reserves the right to change, suspend, remove, disable or impose limits on any External Services at any time without notice or liability to you.
You agree to defend, indemnify and hold harmless Softmatic and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of (a) your use and access of the service(s) and / or product(s), by you or any person using the service(s) and / or product(s) and the external services on your behalf or (b) a breach of these terms.
